1. In General.

GotYour.com is an online network of websites for adults sixteen (16) years of age and older. The services offered by GotYourLimited d/b/a GotYour.com ("GotYour.com" or "we") include the GotYourSpace.com website and all other Got Your websites operating from time to time (the "GotYour Website"), and any other features, content, or applications offered from time to time by GotYour.com in connection with, or through, the GotYour Website (collectively, the "GotYour Services"). Persons under sixteen (16) years of age are prohibited from using the GotYour Services. This Terms of Use Agreement ("Agreement"), together with the GotYour Privacy Policy, as each may be revised from time to time, sets forth the legally binding terms for your use of the GotYour Services. In addition, when using particular GotYour Services, users shall be subject to any posted guidelines or rules applicable to such GotYour Services that may contain terms and conditions in addition to those in this Agreement. You agree to be bound to any changes to this Agreement when you use the GotYour Services after any such modification is posted. Unfortunately, not everyone follows the rules, and other Members may post or communicate information, products or services that are inaccurate, inappropriate, offensive or sexually explicit. 2. International Use.

Although the GotYour Services may be accessible worldwide, we make no representation that GotYour Services are appropriate or available for use in locations outside the United States or the United Kingdom, and accessing them from territories where their contents are illegal is prohibited. Users who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws. Use of and Membership in the GotYour Services is void where prohibited.

3. Age Restriction.

Use of the GotYour Services is strictly limited to persons sixteen (16) years of age or older. If, at any time, we believe that you are under sixteen (16) years of age, we may immediately terminate your access to the GotYour Services without any liability to you.

WITHOUT LIMITING THE FOREGOING, GOTYOUR.COM MAKES NO WARRANTY THAT (A) THE GOTYOUR SERVICES AND CONTENT WILL MEET YOUR REQUIREMENTS, (B) THE GOTYOUR SERVICES AND CONTENT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE GOTYOUR SERVICES OR CONTENT WILL BE EFFECTIVE, ACCURATE, OR RELIABLE, OR (D) THE QUALITY OF ANY PRODUCTS, SERVICES, OR INFORMATION PURCHASED OR OBTAINED BY YOU THROUGH THE GOTYOUR SERVICES, ITS AFFILIATES OR ANY THIRD PARTY WILL MEET YOUR EXPECTATIONS OR BE FREE FROM MISTAKES, ERRORS, OR DEFECTS. 5. Limitation of Damages.

IN NO EVENT SHALL WE OR OUR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, PUNITIVE, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE GOTYOUR SERVICES, THE CONTENT OR ANY WEB SITE REFERENCED OR LINKED TO FROM THE GOTYOUR WEBSITE.

6. Indemnity.

You agree to indemnify and hold GotYour.com, its Affiliates, parents and subsidiaries, and their respective officers, agents, partners and employees, harmless from and against any loss, damages, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of: (a) your use of the GotYour Services in violation of this Agreement; and/or (b) a breach of this Agreement; and/or (c); any breach of your representations and warranties set forth in this Agreement; and/or (d) any Content that you post on the GotYour Website or through the GotYour Services.

7. Intellectual Property

Unless otherwise stated, all names, designs, logos, titles, text, images, audio, video, software or other content contained on the Got Your Website are protected by copyright and other intellectual property rights belonging to Got Your Limited worldwide in perpetuity or its affiliates or licensors and all such rights are herby asserted and reserved. Nothing contained herein shall be construed as granting any licence to use such rights without the written consent of Got Your Limited.

8. Choice of Law and Forum.

This Agreement shall be interpreted and construed in accordance with the laws of the State of Wisconsin, U.S.A., without application of its conflicts of law principles. For the purpose of any dispute arising under, or related in any way to, the subject matter of this Agreement, the you agree that such dispute shall be heard exclusively by the State and Federal courts situated in Madison, Wisconsin, and hereby submit to the exclusive jurisdiction of said courts and waive any objection to the jurisdiction and venue of such courts. You and GotYour.com specifically disclaim application of the United Nations Convention on Contracts for the International Sale of Goods. Notwithstanding the above any dispute that shall arise out of any non U.S.A jurisdiction shall be governed by English Law and the English Courts shall be the courts of exclusive jurisdiction.

9. Company Information.

The GotYour services are offered by Got Your Limited d/b/a GotYour.com, a company formed under the laws of the United Kingdom with offices located at 11A Cambridge Park, Wanstead, London E11 2PU, United Kingdom. 11. Miscellaneous.

This Agreement and the GotYour Privacy Policy constitutes the entire agreement between you and GotYour.com relating to the GotYour Services. You may not assign your rights and obligations under this Agreement to any third party, and any purported attempt to do so shall be null and void. We may freely assign our rights and obligations under this Agreement. Any failure by GotYour.com to enforce or exercise any provision of this Agreement shall not constitute a waiver of that right or provision. GotYour is a trademark of J and H Prosoft Solutions Limited.
